  1. This is the privacy statement of Agorax B.V. (Agorax). With this statement, Agorax informs the reader about how Agorax deals with the personal data that Agorax processes when you use Agorax’s legal services, when you visit Agorax’s website or when you are otherwise in contact with Agorax in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR).
  2. Agorax respects your personal data and ensures that the personal information provided or transferred to us is dealt with confidentially. Personal data concerns all information about a person. Data that indirectly says something about someone is also personal data. The implementation below provides the mandatory information in the GDPR to the data subject(s) whose personal data Agorax processes.

  4. Agorax is a law firm and processes data about natural persons (personal data). This includes data relating to:
    1. Persons who are clients or principals or who work for clients or principals of Agorax;
    2. Third parties whose data are included in the files that Agorax handles, such as opposing parties and other lawyers;
    3. Visitors to the Agorax website
    4. Persons from whom Agorax purchases products or services (suppliers).
  5. Here below Agorax describes per category which personal data Agorax processes (if necessary), for what purposes and on what legal basis.

Clients, principals, counterparties and third parties

  1. Agorax may process the following (categories of) personal data of (contact persons of) clients, counterparties and third parties:

Website visitors

  1. When you visit the website www.Agorax.com Agorax may process a number of personal data:

Suppliers

  1. When Agorax purchases goods and/or services from suppliers and/or service providers, Agorax processes personal data of those suppliers and/or service providers and/or persons who work for them.

Applicants

  1. When you apply for a job at Agorax, Agorax processes your personal data.

How long does Agorax retain your personal data?

  1. Agorax does not store personal data longer than necessary:
    1. For the purposes for which they are collected or processed. For example, Agorax stores personal data that form part of current case files as long as Agorax advises or litigates about this.
    2. To comply with laws and regulations. For example, Agorax stores data necessary for its accounting for seven years.
    3. The personal data that you provide to Agorax for your application will be retained for up to four weeks after the end of the application procedure. If you give permission for this, Agorax will keep your personal data in its portfolio for one year after the end of the application procedure. This gives Agorax the opportunity to contact you for possible vacancies in the future. When you start employment, your personal data will become part of your personnel file.
    4. Personal data processed in the context of our Office Complaints Procedure will be retained for a maximum of two years after the complaint and/or the resulting legal proceedings have been resolved.
    5. For archiving. Agorax moves closed files to an archive. Agorax keeps the file in the archive for 5 years after the file has been closed, in accordance with the recommendation of the Bar Association.

The specific retention periods mentioned above can be extended if legal retention obligations apply. Agorax may also retain personal data for longer if this is necessary to settle incidents and/or legal disputes.

Recipients of personal data

  1. Agorax only shares your personal data with third parties to the extent necessary for the aforementioned purposes. Agorax may share data from clients, counterparties, third parties, website visitors, suppliers and applicants with:
    1. Clients who are involved in the handling of your case because you have engaged them and they Agorax;
    2. Suppliers (such as external translation agencies, bailiffs, accountants and collection agencies);
    3. Opposing parties, other lawyers, insurers, experts, judicial authorities, administrative bodies, government institutions and similar parties;
    4. Suppliers of IT services;
    5. Persons who work on behalf of Agorax, such as its accountant, government institutions, judicial authorities, comparable parties.

In cases other than those mentioned above, Agorax will only share your personal data with third parties if you have given Agorax your permission to do so, to comply with (legal) obligations or if Agorax is forced to do so as a result of a lawsuit and/or to protect the public, own interests or those of third parties.

Transfer

  1. Agorax may use the services of third parties to process your data in accordance with this privacy statement. These parties may be located outside the European Union or they may use servers located outside the European Union, including in the United States. The level of right to protection of personal data may be lower in these countries than in the European Union. If that is the case, Agorax will provide appropriate safeguards, for example by concluding a contract based on model provisions approved by the European Commission (Article 46 GDPR).

Agorax takes the protection of personal data seriously and takes appropriate measures to protect your personal data against destruction, loss, alteration or unauthorized disclosure and unauthorized access. Cookies, or similar techniques, that we use

  1. Agorax will only use technical and functional cookies and analytical cookies that do not infringe your privacy. A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit this website. The cookies that can be used are necessary for the technical operation of the website and your ease of use to ensure that the website works properly and, for example, your preference settings are remembered. You can unsubscribe from cookies by setting your internet browser so that it no longer stores cookies. In addition, you can also delete all information previously stored via the settings of your browser.

Inspection, correction, objection and other rights

  1. Under the GDPR you have the following rights with regard to your personal data:
    1. The right to ask whether Agorax processes your data and, if so, to inspect it;
    2. The right to request rectification of your data if it is incorrect, incomplete or irrelevant, and the right to have your data erased;
    3. The right to object to processing or request restriction of processing;
    4. The right to withdraw consent for processing, if the processing is based on your consent;
    5. The right to receive or issue your data to an organization of your choice, in a structured, commonly used and machine-readable form;
    6. The right to file a complaint with the Dutch Data Protection Authority if you believe that Agorax is processing your personal data unlawfully.
  2. Agorax does not use automated decision-making within the meaning of art. 22 GDPR. A request can be made via info@Agorax.com. Agorax may request additional information from you to verify your identity.
  3. In principle, Agorax will inform you within one month of receiving your request whether it can fulfill your request. This period can be extended by two months under certain circumstances, such as in the case of a complex request. Agorax will of course inform you about this extension within one month of receiving your request. Circumstances may arise that prevent Agorax from (fully) complying with your request, for example in connection with the confidentiality obligation of lawyers or legal retention periods.

  1. This privacy statement was last updated on October 1, 2024. Agorax may amend this privacy statement from time to time. The most recent version of this privacy statement will always be posted on the website Agorax.com. If there are material changes to this privacy statement, a clear notification will follow via the website www.Agorax.com or by informing you directly.
